These terms govern your use of the website lawncare.my and set out the general basis on which Amber Loft Studio Sdn Bhd (Company No. 202101038462 / 1425519-T) ("the Studio") provides its services. By using this website you accept the website terms; engagement of our design or construction services is always governed by a separate written agreement signed by both parties, which prevails over anything on this page.
1. About this website
The content of this site — text, photography, project descriptions and pricing indications — is provided for general information. It describes our typical practice, not a binding offer. Figures such as "from RM 38,000" are indicative starting points; every project is priced individually in writing after a consultation.
2. Consultations and proposals
Initial consultations are provided free of charge and without obligation. Proposals, concept sketches and feasibility notes prepared for a consultation remain the Studio's property until a design agreement is signed. Acting on unpaid concept work without engaging the Studio is a breach of these terms.
3. Engagements and payment
All engagements proceed under a written agreement specifying scope, fixed price, programme and payment milestones. Unless stated otherwise in that agreement, invoices are payable within fourteen days, work may be paused on accounts more than fourteen days overdue, and title in supplied goods passes on full payment.
4. Variations and site conditions
Changes requested after the agreement is signed, and works necessitated by concealed site conditions that could not reasonably have been detected during survey, are handled through written variation orders priced before execution. No variation proceeds without the client's signature.
5. Warranty
The Studio provides a twenty-four month workmanship warranty from the date of practical completion, covering work executed by the Studio and its subcontractors. It does not cover fair wear and tear, misuse, unauthorised modification, or products covered by their own manufacturer warranties, which we assign to the client at handover. 6. Intellectual property
Drawings, models, specifications and photography produced by the Studio remain our intellectual property. Clients receive a licence to use project documentation for the operation, maintenance and future alteration of their own property. We may photograph completed projects for our portfolio; clients may decline this at any time and we will respect it without question.
7. Liability
Nothing in these terms excludes liability that cannot be excluded under Malaysian law. Otherwise, the Studio's aggregate liability in connection with this website is limited to RM 1,000, and liability under a service agreement is as stated in that agreement. We are not liable for indirect or consequential losses such as alternative accommodation costs arising from delays caused by events beyond our reasonable control.
8. Governing law
These terms are governed by the laws of Malaysia, and the courts of Kuala Lumpur have exclusive jurisdiction over any dispute arising from them.
